Focus On Restoring Balance To Commerce
In 1991 Congress enacted the Telephone
Consumer Protection Act ("TCPA") that among other things prohibited the sending
of unsolicited commercial faxes. While the FCC had decided to ban all commercial faxes
where the sender did not have express written consent from the recipient,
Companies engage in deceptive advertising when they advertise products with features that do not work or perform as advertised, or advertise prices at which they do not intend to sell a good or service. There are numerous laws and regulations at both the state and federal levels designed to protect consumers. Contact us to see if the Center for Legal and Responsible Commerce can help you with your case.
Besides making the
claim period extremely short, and the claim procedure tedious, many retailers
and manufactures offer rebates with no intention of paying properly submitted
rebates, in a timely manner, if at all. These cases are particularly well suited
for class action resolution as the damages are easily calculable, the damages
while not worth pursuing on an individual basis are substantial when aggregated
and there is significant national
uniformity of law with respect to the causes of action relevant to a rebate
fraud claim. Please click here to go to our RebateFraud.com project site,
where you discuss with other consumers your experience with rebates and various
companies handling of them.
For some reason all of the news/discussion these days is about the cost of fraud committed by claimants against insurers and how it is driving up the cost of insurance. What is not being discussed are the deceptive and unfair practices of insurers, or the poor enforcement of the insurance code by many departments of insurance. Congress intervened on behalf of business with the
Junk Fax Prevention Act of 2005. This law allows any business you have done business with at anytime to send you unsolicited faxes pushing goods and services. Click here to find out what you can do to stop receiving junk faxes from companies that were not exempted from the TCPA by the
Junk Fax Prevention Act of 2005.
There are no less than five federal laws that protect consumers from creditors. While it may seem that you have no rights against your large creditor(s), these laws give you significant rights against your creditors and credit reporting agencies. We will not get you out of debt or help you with bankruptcy, but we will help make sure you only pay debts that you legitimately incurred and help you recover losses incurred due to creditor malfeasance.
